The terms that govern your use of EcomWiz Customer Service — the unified customer-support platform for WooCommerce merchants.

1. Acceptance of Terms

By accessing or using EcomWiz Customer Service ("the Service"), operated by EcomWizzard ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

EcomWiz Customer Service is a SaaS platform that provides e-commerce merchants with a unified customer-support inbox spanning email, Facebook Messenger, and Instagram Direct messages, along with AI-assisted reply drafting and analytics. Integrations with WooCommerce, Gmail, Facebook, Instagram, and other platforms are subject to each platform's own terms.

The Service integrates with third-party platforms (Meta, Google, WooCommerce, others). Your use of these integrations is governed by each provider's terms and privacy policies. We are not responsible for the actions, content, or practices of any third-party platform. Disconnecting a third-party integration may limit features but will not affect your account otherwise.

You retain all rights to the data you upload, sync, or generate through your use of the Service ("Your Data"). You grant EcomWizzard a limited, non-exclusive license to host, store, process, and display Your Data solely for the purpose of providing the Service.

The Service, including its software, design, trademarks, and branding, is the property of EcomWizzard and is protected by copyright, trademark, and other laws. You may not copy, modify, or create derivative works of the Service.

9. Service Availability

We strive to keep the Service available 24/7 but do not guarantee uninterrupted access. Scheduled maintenance, third-party outages, and force-majeure events may cause downtime. We are not liable for any loss resulting from unavailability.

10. Termination

You may close your account at any time by emailing barak@refael.net. We may suspend or terminate your access immediately if you breach these Terms, violate third-party platform rules, or engage in fraud. Upon termination, your access ceases and Your Data may be deleted in accordance with the Data Deletion policy.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECOMWIZZARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE FEES YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify and hold EcomWizzard harmless from any claim or demand arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which EcomWizzard is established, without regard to its conflict-of-laws principles. Any disputes shall be resolved in the courts of that jurisdiction.

We may revise these Terms from time to time. Material changes will be communicated to active account holders by email at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.
